The Consumer Protection Act, 2019 provides a relatively quick and inexpensive remedy for defective goods, deficient services and unfair trade practices. Complaints can be filed online through the e-Daakhil portal of the National Consumer Disputes Redressal Commission.

Which Commission?

Pecuniary jurisdiction depends on the value of the goods or services paid for. Under the current rules, District Commissions hear complaints up to ₹50 lakh, State Commissions above ₹50 lakh and up to ₹2 crore, and the National Commission above ₹2 crore.

Before you file

  • Collect the invoice, warranty card and all correspondence with the seller or service provider
  • Send a written complaint or legal notice giving them a chance to resolve the issue
  • Note that a complaint must ordinarily be filed within two years of the cause of action

The Commission can order repair, replacement, refund, compensation and costs. Many matters are also referred to mediation, which can produce faster results.
