Child Custody

Custody, guardianship and visitation arrangements decided on the welfare of the child.

In custody matters the welfare of the child is the paramount consideration. Courts decide physical custody, guardianship and visitation under the Guardians and Wards Act, 1890 and the Hindu Minority and Guardianship Act, 1956, looking at the child's age, schooling, emotional ties and each parent's circumstances.
