Maintenance can be claimed under Section 144 of the Bharatiya Nagarik Suraksha Sanhita (formerly Section 125 CrPC), Sections 24 and 25 of the Hindu Marriage Act, the Hindu Adoptions and Maintenance Act and the Domestic Violence Act. Following the Supreme Court's guidelines in Rajnesh v. Neha (2020), both parties file affidavits disclosing their income, assets and liabilities.
